Woman files lawsuit against Tulsa

TULSA, Okla. -- The University of Tulsa is being sued by a woman who alleges she was raped by basketball player Patrick Swilling Jr. in January.

Swilling was suspended for the remainder of the basketball season, but prosecutors declined to charge him and the university cleared him of any violations of the student code of conduct. He is not a part of the lawsuit.

The lawsuit filed Monday in federal court claims emotional distress, negligence, and that the school was indifferent to the rape report. It asks for damages to be determined by a jury, plus interest and attorney fees.

The university issued a statement saying it has a "robust policy" for investigating sexual harassment and assault claims and that the policy was carried out.
